Terms and Conditions

Notice - Should you disagree with any of the terms and conditions, you are welcome to contact us to discuss an exception, or to address elements of the terms and conditions which you find problematic.

  1. General Terms of service
    1. Our services are provided on a best effort basis.
    2. Our liability to you will be limited to the equivalent of 1 months service provided by us.
    3. In no event will we be liable for third party charges, loss of goodwill, or consequential losses.
    4. The parties agree to the jurisdiction of the New Zealand Courts
    5. Where we explicitly agree to any variation of these terms, we must do so in writing for the terms to take effect. Where those terms have been provided in writing, they, will override these terms.
  2. Privacy
    1. We will take reasonable steps to protect your privacy.
    2. We will not provide your details to any third company for the purposes of marketing or sales.
    3. We will not disclose any information we hold about you without your permission, except if required to collect debt, if required to by court order, or if we become aware of criminal activity. For the sake of clarity, We do not accept that a criminal activity can take place unless an individual suffers harm, or would suffer harm as a result of the activity.
    4. Note that we may record conversations between us. Where there is a recorded conversation, you acknowledge that this may be used in legal proceedings.
    5. We may enquire about your credit worthyness with any other party, and may provide our opinion on your credit worthyness to a third party, unless you explicitly withhold consent to do so.
  3. Termination and Charges, Payment Terms and Penalties
    1. Unless there is a fixed term contract, either party may terminate the agreement with 1 months written notice.
    2. You acknowledge that unless the service is cancelled in writing, we will charge you for your ability to use the service, whether or not you took advantage of the service.
    3. We may suspend or terminate the service without notice for a breach of our terms and conditions. Not withstanding our suspending service, no refund will be given for the time service is unavailable in this event.
    4. Where the account is paid in advance, no refunds will be given on the account, should the account be terminated.
    5. These terms and conditions may be changed with 1 months notice. Posting new terms on the nzoffice.net website will constitute notice. We will also send an email to your address on record to notify you.
    6. You agree to pay all fees and charges for the service for which you are subscribed, without deduction or offset.
    7. Should your account be overdue, we charge interest at the rate of 2.5% per month. Should collection procedures be implemented you agree to pay the costs of collection in addition to the cost of the debt. Should your account become overdue we may charge $100 collection fee in addition to other charges above.
    8. Any item sold by us to you remains our property until paid for in full by you.
    9. Legal Costs - Should we need to take legal action (including arbitration), all costs in so doing will be at your expense.
    10. You agree that we may make enquiries about your credit worthiness, and disclose any information relating to the standing of your account to third parties.
    11. You agree that we are not obliged to do anything for you if payment is over due, however any monthly base fees will still be payable by you.
  4. Mail Services
    1. You acknowledge that we have the right open any mail which is sent to the address we provide you with. In turn, we will take reasonable care in keeping the contents of any mail we open confidential.
    2. Where you elect for us to forward mail on to you unopened, we reserve the right to open the mail if we have any reason to believe it might contain anything other then a paper document.
    3. You SPECIFICALLY acknowledge that we will typically open all non-document packages to verify its contents before forwarding it on to an international destination, so as to be able to correctly and accurately handle the customs declarations, and to ensure we meet postal requirements.
    4. You agree to fully indemnify us for loss of any post. Our liability will be limited to assisting you with lodging a fault with any carriers that may be involved, and forwarding any funds received from them to you, less our reasonable expenses in assisting you.
    5. You agree that in setting up an account with us, you are appointing us to act as your agent.
    6. Should your account become overdue, or remain unpaid or in arrears for more then 7 days, we may refuse to accept mail for you, and we may accept mail for you and discard it. Where we are holding mail for you, we may discard it. We may also open any mail, and use its contents to offset any amount due to us.
  5. Internet Services
    1. You agree To keep us informed of any changes to your contact details, including e-mail address.
    2. You are responsible for the use any services where your username and password are used. You should not share your password with others, as you will be held liable for their actions.
    3. You will not to engage in illegal activities while connected to the system.
    4. You will not send unsolicited mass e-mails (SPAM) through the system, or to engage in any spam like activity whether through our systems or otherwise.
    5. You agree not probe or hack into any system on the Internet, except with full permission of the system owner.
    6. You acknowledge that technicians and contractors may control, monitor and/or log traffic going through our system for the purposes of network management and to fulfill any legal obligations we may have.
    7. In no event will we be liable for telco charges of any sort.
  6. Banking Assistance
    1. We do not hold ourselves out as being a bank and do not operate a trust fund.
    2. We will notify and actively work with the police and/or Inland Revenue if the transaction looks suspicious and we are involved with handling the funds.
    3. Where we allow you to use one of our bank accounts, we will not forward funds on until funds have been cleared.
    4. We reserve the right to stop offering this service at any time, and without advance notice, in which case our sole obligation will be to reimburse you for any moneys which have already been banked into our account
    5. We will not be liable to you should your money be frozen for any reason
